Welcome to Contrak, a contraction timer and labor tracking app designed to help expectant parents monitor contractions and prepare for childbirth. By downloading or using our app, you agree to comply with and be bound by the following Terms and Conditions. Please read them carefully, especially the Medical Disclaimer and Emergency Guidance section.

Acceptance of Terms

By accessing or using Contrak, you agree to these Terms and Conditions and any additional terms applicable to certain features or services. If you do not agree, please discontinue use of the app immediately.

Eligibility

Contrak is designed for pregnant individuals and their support persons. By using the app, you confirm that you are at least 18 years old or have parental/guardian consent to use the app.

Account Registration

To access certain features, you may be required to create an account. You agree to: • Provide accurate, current, and complete information during registration. • Keep your login credentials secure. • Notify us immediately of any unauthorized use of your account.

Use of the App

Contrak is designed to help you track contractions, monitor labor patterns, and prepare for childbirth. You agree to use the app responsibly and in accordance with these Terms. You may not: • Use the app for unlawful purposes or activities. • Disrupt or interfere with the app's functionality. • Attempt to reverse-engineer or exploit the app's software. • Share false or misleading information within community features.

Medical Disclaimer and Emergency Guidance

CRITICAL MEDICAL DISCLAIMER: Contrak is a contraction timing and tracking tool, NOT a medical device, diagnostic tool, or substitute for professional medical care. ⚠️ WHEN TO SEEK IMMEDIATE MEDICAL ATTENTION: • If you experience severe pain, heavy bleeding, or sudden fluid loss. • If you notice decreased fetal movement or no movement for several hours. • If contractions are regular and intense (typically 5 minutes apart, lasting 1 minute, for 1 hour - the "5-1-1 rule" - but always follow your healthcare provider's specific guidance). • If you have any concerns about your pregnancy or labor. • If you are less than 37 weeks pregnant and experiencing regular contractions (potential preterm labor). IMPORTANT: • Always consult with your healthcare provider, obstetrician, or midwife for medical advice. • Do not rely solely on Contrak to determine when to go to the hospital or call your healthcare provider. • Follow your healthcare provider's specific instructions about when to contact them or go to the hospital. • In case of emergency, call emergency services (911 in the US) immediately. • The app's suggestions and alerts are for informational purposes only and should not replace professional medical judgment. By using Contrak, you acknowledge that it is not a substitute for professional medical care and that you will seek appropriate medical attention when needed.

Privacy and Data

We are committed to protecting your privacy and pregnancy data. Please review our Privacy Policy to understand how your data is collected, used, and stored. By using the app, you consent to the practices described in the Privacy Policy.

Paid Subscriptions and Billing

Certain features of Contrak are available through a paid subscription. By purchasing a subscription, you agree to: • Pay all applicable fees promptly. • Allow us to charge your provided payment method for recurring subscriptions until you cancel. Cancellation and Refunds: You can cancel your subscription at any time through the app or your device's app store. Refunds are subject to our discretion and applicable app store policies.

User Content and Pregnancy Data

You retain ownership of all pregnancy data, contraction records, notes, birth plans, and other content you create within Contrak. By using the app, you grant us a limited license to store and process this content to provide our services. • Your pregnancy and labor data is private and will not be shared with third parties except as described in our Privacy Policy. • You are responsible for the accuracy of the information you log. • You may export or delete your data at any time.

Data Sharing with Healthcare Providers

Contrak allows you to export and share contraction reports with your healthcare provider. When you choose to share data: • You are responsible for ensuring you share with the correct recipient. • We are not responsible for how healthcare providers use or store the shared data. • Shared reports are for informational purposes and should be reviewed by qualified medical professionals.

Partner and Support Person Access

You may choose to share real-time contraction data with your partner, doula, or support person. When you enable this feature: • You are responsible for managing who has access to your data. • You can revoke access at any time. • Shared data is subject to the same privacy protections as your own data.

Disclaimer of Warranties

Contrak is provided on an 'as-is' and 'as-available' basis. We do not guarantee the app will be free of errors, interruptions, or security vulnerabilities. • The app's contraction timing may not be 100% accurate. • Notifications and alerts may be delayed or fail to deliver. • The app should not be relied upon as the sole method for monitoring labor. • Results and experiences may vary for individual users.

Limitation of Liability

To the fullest extent permitted by law, Contrak and its creators are not liable for: • Any direct, indirect, incidental, or consequential damages resulting from the use or inability to use the app. • Loss of data, reputation, or profits arising from the app's use. • Any pregnancy, labor, or birth outcomes related to or arising from the use of the app. • Delays in seeking medical care due to reliance on the app. • Inaccurate contraction timing or pattern analysis. • Technical failures, including but not limited to notification failures or data loss. You acknowledge that you use Contrak at your own risk and that the app is not a substitute for professional medical monitoring during pregnancy and labor.

Community Guidelines

Contrak may offer community features for users to share birth stories and support each other. By participating, you agree to: • Respect other users' privacy and experiences. • Refrain from posting medical advice or diagnosing other users. • Not share graphic or disturbing content without appropriate warnings. • Keep discussions supportive, educational, and respectful. • Understand that community advice is not a substitute for professional medical care. Violation of these guidelines may result in suspension or termination of your account.

Intellectual Property

All content, trademarks, and materials provided through Contrak are the property of the app's creators or licensed to us. You may not reproduce, distribute, or modify this content without prior permission.

Changes to Terms

We may update these Terms and Conditions periodically. Continued use of the app after such changes constitutes your acceptance of the new terms. We recommend reviewing this document regularly.

Termination

We reserve the right to suspend or terminate your access to Contrak at our sole discretion, without prior notice, for violation of these Terms or any applicable laws.
